Abstract
Este artículo plantea la necesidad de fundamentar teóricamente la noción de dolo utilizada en la legislación penal colombiana, así como su desarrollo jurisprudencial, a fin de superar las profundas dificultades que se presentan al momento de demostrar tal categoría en los casos concretos. Para ello, se revisa la forma como el dolo es tratado por la Corte Suprema de Justicia en diversas sentencias; se problematiza y cuestiona mostrando las debilidades de asumir su postura; finalmente, se propone una revisión desde la perspectiva de Aristóteles y Schopenhauer para solucionar la dificultad de su prueba y contribuir a su fortalecimiento filosófico.
