Abstract

El presente escrito pretende sustentar que el concepto puro del derecho, como lo presenta la filosofía practica kantiana, es fundamental para pensar normativamente la democracia, la libertad y la posibilidad de una paz democrática estable en contraste con una paz como modus vivendi o un precario equilibrio de fuerzas. La libertad que se debe considerar en la democracia colombiana es la propuesta Philip Pettit, esto es, una libertad republicana que, por medio del control constitucional, rechaza las interferencias arbitrarias de las instituciones oficiales y privadas sobre la ciudadanía. Con lo anterior, se puede considerar, entonces, que Colombia se debe pensar como una utopía realista.
